Carrying drugs on vacation not a crime in Italy, court rules


(ANSA) - Rome, September 11 - Carrying large amounts of
drugs for personal use while on vacation does not make you a
drug dealer, the Italian Supreme Court ruled Tuesday.
The decision came in a case regarding a 38-year-old Italian
man who was caught rolling a joint of hashish while skiing in
the Alps.
He was found to be carrying 48 grams of the drug, enough
for 161 portions, which authorities had ruled to be too much for
personal use given he was only visiting and charged him with
intending to deal drugs.
Despite exceeding the legal limit, the Cassation Court
ruled Tuesday that "merely surpassing the threshold" does not
prove the suspect's intent to deal, especially when it is "by a
small margin".
The case will now go before a review court.
