Rome, August 16 - A mother who repeatedly branded
her son's teacher as gay, rude and a paedophile in retaliation
to his having flagged bad behaviour in the classroom by the
youngster was fined 800 euros by a top criminal court for
defamation and for moral damages sustained by the man in
question.
Thirty-eight year old Simona P. from Sardinia will be
forced to pay the fine for having said the English teacher at
the school which was attended by her son was "a gay" on the
phone during a conversation with a school employee.
The woman also went on to call the teacher a "paedophile,
gay and rude" in another phone conversation she had with the
school head.
The woman had appealed previous sentences at the Court of
Cassation, saying she had been acting in "legitimate defence"
out of concern for her son, claiming the "English teacher wanted
to hug him, since he is gay".
Simona P.'s attempt to also claim she was simply passing on
rumours about the sexual preferences of the teacher circulating
in the school were also rejected by the Tribunal, as prosecutors
called for the mother to pay the damages to the teacher who the
mother "with much anger" slandered "in a continuous manner".
Her attempt at justifying her action was rejected by the
Court of Cassation appeals judges, upholding an earlier April
2012 verdict and also a previous one issued by a Justice of the
Peace in July 2011 with the new sentence n. 35105.
